Portraiture Session Contract Agreement: >>>
** (1) ** Retainer: A retainer fee is required for all portrait sessions.
This is a non-refundable retainer. In the event of cancellation, the retainer paid is non-refundable. It shall be liquidated for damages to the Photographer in the event of a cancellation, or breach of contract by the Client. No date is reserved until a retainer is received. The retainer shall be applied toward the total cost of the service to be rendered. The remaining balance of the complete package price must be paid 24 hours before the day of the event. If final payment is not received within 24 hours of the event, the Photographer will not be expected to attend said event.
** (2) ** Premium Venue Fee: If elected, this non-refundable fee is in accordance with the third-party venue provider's strict policy. In the event of cancellation, the venue fee paid is non-refundable.
** (3) ** Cancellation Clause: There shall be no refund of retainer after the signing of the Agreement and the reservation of the photography date. Should the client cancel the photography session outside of 72 hours of the scheduled date, the sitting fee will be refunded, while upfront costs, such as the retainer or venue fees, are strictly non-refundable, except if the photographer cancels the session due to unforeseen events precluding the session. Should this situation arise, all funds will be returned. In the event of a client's cancellation of a photography session within 72 hours of the scheduled date, a refund will not be granted unless supported by verified documentation of an unforeseen life event such as a death in the immediate family, hospitalization, a police report, or a natural disaster. To cancel, you must submit the Cancellation Notice form found on the website. Should the form become inaccessible, the client retains liability and must inform the photographer via email, providing written notice as a substitute for cancellation.
** (4) ** Failure to perform: The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. Due to the limited timeframe and subjective nature of the event, the Photographer cannot be held responsible for requested photographs not taken or missed, lack of coverage resulting from weather conditions, or schedule complications caused by but not limited to, anyone in or at the event, or by unforeseen location restrictions. The photographer is not responsible for lost photo opportunities due to other cameras or flashes, the lateness of the clients or other principles. The photographer is not responsible for the lack of coverage due to weather conditions, scheduling complications due to lateness of individuals, rules and restrictions of venue, or the rendering of decorations of the location. The Photographer will do its best to fulfill all requests but can make no guarantees all images will be delivered. The photographer is not responsible if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to the photographer.
** (5) ** Punctuality Policy: The photographer is not accountable for client delays arising from personal or travel issues. The photographer will allow a 15 minute leeway but charge an additional $25 fee due before image delivery since this breach of time takes away from the photographer's personal breaks in between scheduled sessions. If the client's arrival exceeds fifteen minutes past the scheduled time, the photographer and client will need to complete the session within the remaining duration. The photographer is not responsible for any alterations to the pre-agreed image count if time becomes a limiting factor. Rescheduling is at the client's discretion, but no refunds will be issued absent a valid justification, as stipulated in the aforementioned Section 3 - Cancellation Clause.
** (6) ** Copyright: Title (possession) of and copyright to all products shall remain with the Photographer until the client has paid in full. All photos are copyrighted. The negatives and or digital images (hereinafter collectively the "images") created by the Photographer and/or subcontractor(s) remain the property of the Photographer. It is illegal to copy, scan, reproduce, or post online in forums or elsewhere without the written permission of the Photographer. Violators of this federal law will be subject to its civil and criminal penalties.
Permission is hereby granted to the Photographer to use any images created under this contract for professional samples, displays, internet website pages, advertising, exhibitions, contests, and any other purpose. The photographer retains the copyright to all images produced by the photographer and/or the photographer's subcontractors. The client understands that all posting of images on the internet must be acknowledged as images by the Photographer.
** (7) ** Creative License: Images are edited at the photographer's discretion and delivered images may not include all images shot. The photographer reserves the creative rights to edit and release only those images deemed creditable as professional in quality and within the photographer's artistic standards.
** (8) ** Force majeure: If the Photographer or its assigns cannot perform this Agreement because of a fire, casualty, strike or other civil disturbances, Acts of God, including but not limited to, road closures, severe traffic, fire, terrorism or other causes beyond the control of the parties, then the photographer shall return any moneys paid by the Client, less retainer fee and venue expenses, but shall have no further liability regarding the Agreement. This limitation of liability shall also apply if photographic materials are damaged, lost through camera malfunction, compact flash card malfunction, or otherwise lost or damaged without fault by the photographer. Provided the aforementioned event takes place, the photographer will refund the sitting fee if it is deemed a loss.
** (9) ** General Safety Disclaimer: The Client will take all measures for ensuring their own safety traveling to the session, during the session, and upon the ending and thereafter the session. The photographer maintains the discretion to cancel an event due to safety concerns related to the session location or the prevailing weather, affecting either party. The photographer assumes no liability for any injuries or accidents.
** (10) ** Participant Behavior: The client is responsible for the conduct of all members of their party during the session. The photographer bears no responsibility for issues stemming from disruptive conduct.
The photographer retains the right to terminate the session in response to verbal disputes or threats of physical harm amongst the client's party or toward the photographer.
** (11) ** Feral Animal, Insect, and Pet Behavior Disclaimer: The Photographer cannot control the behavior of feral animals, insects, or domesticated animals, including pets, during the session. The photographer is not liable for any incidents or limited results because of outdoor nature and animal behavior.
